RateMyShift – A Product of Worksight LTD

These Terms and Conditions (“Terms”) govern your access to and use of the RateMyShift website and web application (the “Service”).

By accessing or using the Service, you confirm that you have read, understood, and agree to be legally bound by these Terms.
If you do not agree to these Terms, you must not use the Service.

Definitions

Company means Worksight LTD (Company No. 16058573), The Bakehouse, Blagdon Hill, Taunton, Somerset, United Kingdom, TA3 7SF.
Service means:


User, You, or Your means any individual or legal entity accessing or using the Service.
Account means a registered user profile created to access the Service.
Content means any text, graphics, data, ratings, comments, analytics, software, designs, or other materials available through the Service.

Organisation means an NHS Trust, employer, or other entity subscribing to or using the Service.

Age and Eligibility

You must be at least 16 years of age to use the Service.

If you are under 18 years of age, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

The Service is intended for workforce professionals. It is not intended for patients or members of the general public.

Using Our Service

Use of the Service constitutes acceptance of these Terms.

If you do not agree to these Terms, you must immediately cease using the Service.

Account Registration and Security

To access certain features, you must create an Account.

You agree to:

  • Provide accurate, current, and complete information

  • Maintain the security and confidentiality of your login credentials

  • Notify us immediately of unauthorised use of your Account

  • Accept responsibility for all activities conducted under your Account

We reserve the right to suspend or terminate Accounts that breach these Terms.

Permitted Use and Authorised Access

You may use the Service solely for lawful workforce feedback, analytics, and coordination purposes.

Authorised Data Access

Users are authorised to view:

  • Their own submitted ratings, comments, and data

  • Aggregated, anonymised data relating to their team or organisation where access has been granted

  • Any information explicitly made available to them by the Organisation or the Company

Users are not authorised to:

  • Access individual-level data belonging to other users unless explicitly permitted

  • Attempt to identify individuals from aggregated data

  • Access administrative or restricted datasets

  • Circumvent role-based access controls

Any attempt to access data beyond your authorised permissions may result in immediate suspension or termination.

Acceptable Use

You agree not to:

  • Violate any applicable laws or regulations

  • Upload or share patient-identifiable information

  • Harass, intimidate, or discriminate against other users

  • Submit unlawful, abusive, defamatory, or harmful content

  • Upload malware, malicious code, or attempt to disrupt the Service

  • Reverse engineer, copy, scrape, or commercially exploit the Service

  • Interfere with security features or system integrity

We may investigate suspected breaches and take appropriate action, including suspension, termination, or legal action.

User-Generated Content

You retain ownership of the content you submit.

By submitting content, you grant Worksight LTD a worldwide, non-exclusive, royalty-free licence to:

  • Use

  • Store

  • Reproduce

  • Analyse

  • Modify

  • Display

such content for the purposes of operating, improving, and analysing the Service.

You confirm that:

  • Your content does not breach confidentiality obligations

  • Your content does not contain patient-identifiable data

  • You have the right to submit the content

Data Ownership and Analytics

  • Individual users own the personal feedback they submit.

  • Organisations own the aggregated analytics and reporting generated for them under their subscription.

  • Worksight LTD owns the platform, software, algorithms, benchmarking methodologies, system architecture, and anonymised datasets.

We may use anonymised or aggregated data for:

  • Service improvement

  • Workforce analytics

  • Benchmarking

  • Academic or industry research

Such use will never identify individual users.

Organisation Accounts

Where the Service is accessed through an Organisation:

  • Organisation administrators may access aggregated team-level data

  • Individual feedback remains confidential unless explicitly stated otherwise

  • The Organisation is responsible for managing internal user access rights

  • A separate commercial agreement between Worksight LTD and the Organisation may override these Terms where applicable

Purchases and Subscriptions

Where subscription plans or paid features are offered:

  • Prices and terms are displayed at checkout

  • Payment is processed securely

  • Subscriptions renew automatically unless cancelled before renewal

  • Users may cancel through account settings

If purchasing on behalf of an Organisation, you confirm that you have authority to bind that Organisation.

Refunds are handled in accordance with UK consumer law.

External Links and Third Parties

The Service may contain links to third-party websites or services.

We are not responsible for:

  • The content of third-party websites

  • Their privacy practices

  • Their terms of service

Third-party service providers may process data on our behalf (for example, hosting providers, analytics services, payment processors). Such providers operate under contractual data protection obligations.

Intellectual Property

All intellectual property rights in the Service, excluding user-submitted content, are owned by Worksight LTD or its licensors.

You may:

  • Access and use the Service for internal, non-commercial purposes

You may not:

  • Reproduce, redistribute, sell, licence, or commercially exploit any part of the Service without written permission.

Indemnity

You agree to indemnify and hold harmless Worksight LTD from any claims, damages, liabilities, losses, or expenses arising from:

  • Your misuse of the Service

  • Your breach of these Terms

  • Your violation of applicable laws

Limitation of Liability

To the fullest extent permitted by law:

  • The Service is provided “as is” and “as available.”

  • We do not guarantee uninterrupted or error-free operation.

  • We are not liable for indirect, incidental, or consequential damages, including loss of data or profits.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under English law.

Suspension and Termination

We may suspend or terminate your access:

  • If you breach these Terms

  • If required by law

  • If necessary to protect system integrity or other users

You may stop using the Service at any time.

Changes to the Service or Terms

We may:

  • Modify the Service

  • Suspend features

  • Update these Terms

Continued use of the Service after updates constitutes acceptance of the revised Terms.

Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

General Provisions

If any provision of these Terms is found invalid, the remaining provisions remain enforceable.

These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Worksight LTD.

No third party has rights under these Terms pursuant to the Contracts (Rights of Third Parties) Act 1999.

Any claim must be brought within one (1) year of the event giving rise to it.
